Mike Mustafa appeals following acceptance of his guilty plea. He argues that his guilty plea was not knowing, voluntary, and intelligent, and that the district court erred in relying upon the money laundering guideline in calculating his sentence. We affirm the district courts use of the money laundering sentencing guideline, and we conclude that his plea was knowing, voluntary, and intelligent. Accordingly, we deny Mustafas request to withdraw his guilty plea. However, we conclude that the district court did err in not considering Mustafas ability to pay the restitution that was imposed in the amount of $732,223. Accordingly, we will remand for resentencing proceedings consistent with this opinion.
