Submitted: September 22, 1998 Appeal from the United States District Court for the Eastern District of Arkansas. Barron Jerome Nelson (""Nelson"") was charged in a two-count indictment with conspiracy to possess with intent to distribute cocaine base in violation of 21 U.S.C. § 846, and possessing with intent to distribute approximately four ounces of cocaine base in violation of 21 U.S.C. § 841. Prior to trial, the district court 1 denied Nelson's motion to suppress evidence found pursuant to a search warrant, and also denied Nelson's motion to dismiss the conspiracy count of the indictment. Following a jury trial, Nelson was found guilty on both counts and was sentenced to a term of 120 months imprisonment on each count, to be served concurrently, to be followed by five years supervised release, and a $100 special assessment.
